SunaHealth Labs Product Sale Policy
- Overview
1.1 SunaHealth Labs products are professional use only supplements that can only be:
- a. Acquired by a qualified healthcare professional (Practitioner) for personal use. b. Supplied to a Practitioner’s patients either in person or virtually, consistent with the Practitioner’s professional regulations, association, and code of conduct.
- Acquired by a patient with a valid prescription via a verified stockist.
1.2 This policy outlines SunaHealth Labs’ approach in working with qualified healthcare professionals, including those employed by retailers such as health food stores and pharmacies (“retailers”) that are interested in selling SunaHealth Labs products.
1.3 In this policy, the term “retail stores” or “retailers” includes pharmacies and health food stores.
1.4 The terms “patient” and “consumer” may be used interchangeably within this policy.
1.5 SunaHealth Labs reserves the right to contact relevant healthcare professional associations regarding any issues involving its brand, products, or reputation.
1.6 Account holders are responsible for ensuring that any purchaser of SunaHealth Labs products adheres to the requirements of this policy if the purchaser re-sells the products.
1.7 Retail accounts can only be opened once approved by SunaHealth Labs or its distributor, after account application terms and conditions have been signed. All retail account holders must read, sign, and return a copy of this policy and other applicable policies to be supplied with SunaHealth Labs products.
- Requirements for Supplying SunaHealth Labs Products
2.1 The Practitioner must only supply SunaHealth Labs products if:
- The Practitioner operates a clinic or store with an appropriate allowance of space to conduct a required consultation.
- The Practitioner prescribes products to a patient within the context of a consultation, consistent with their professional association, regulations, and code of conduct.
2.2 SunaHealth Labs products are not commercially available for purchase by the general public. Practitioners must ensure that SunaHealth Labs products are not displayed in a public walk-in retail environment. All products must be secured behind lock and key, or securely behind the counter where accessible by practitioners.
- Online Sales and Social Media Requirements for Online Presence and Sales
3.1 SunaHealth Labs permits Practitioners to use brand and product details in their clinic and online (via website or social media) under the following conditions:
- Public access areas of Practitioner websites and social media may include:
- SunaHealth Labs product images and label content (available in an approved form directly from SunaHealth Labs).
- SunaHealth Labs logo.
- It is the responsibility of the Practitioner to ensure that any public-facing SunaHealth Labs imagery complies with the Therapeutic Goods Administration Advertising Code and the Practitioner’s professional association, regulations, and code of conduct.
- Pricing should only be made available in a secure log-in section of the Practitioner’s website for prescribed products.
- Online supply of SunaHealth Labs products must occur via a secure log-in section for patients. Online patients can only access products after important screening questions have been asked to ensure that the product is suitable for them.
- Dispensing in Retail Environments
4.1 SunaHealth Labs products may be stocked in a retail environment if the following criteria are met:
- Retail accounts may be opened under a business name, but the account must be associated with a qualified healthcare professional approved by SunaHealth Labs, with their professional association details on file.
- SunaHealth Labs products must be dispensed under the supervision of a qualified healthcare professional. Non-qualified staff are not permitted to prescribe or sell these products.
- To help ensure product quality and efficacy, transferring stock between retail outlets that do not hold an active account with SunaHealth Labs is not permitted unless agreed to by SunaHealth Labs.
- Retailers will be periodically reviewed to ensure compliance with SunaHealth Labs’ ethical standards for professional patient care and product safety.
4.2 SunaHealth Labs products must be provided to patients under the care of a qualified healthcare professional following required screening questions. Patient records should be maintained according to professional standards.
- Intellectual Property and Marketing
Overview
5.1 SunaHealth Labs retains full control over its intellectual property, brand placement, advertising, and marketing.
5.2 Written permission is required to use any SunaHealth Labs images, text, or logos on websites, printed materials, or any other media.
5.3 All images and logos must be used in accordance with SunaHealth Labs’ guidelines and must clearly credit SunaHealth Labs as the source.
